Rental Agreement & Terms and Conditions

1. 1

   Payment & Booking Confirmation

   Payment Clearance Required: A vehicle reservation is not guaranteed or locked into our schedule until full payment of the total rental amount has been cleared and verified by 313 Rentals.

   Payment Methods: Payments can be made securely via Visa/Mastercard payment links dispatched upon request approval, direct debit card, or cash. (Note: Pre-authorization on payment cards is not used.)

   Security Deposit & Traffic Fines

   Tiered Security Deposit: A refundable security deposit is payable upon vehicle pick-up: All Sedans & Wagons – $150.00 FJD. All SUVs – $300.00 FJD.

   Coverage: This deposit covers initial post-rental clearances, unpaid traffic infringement notices or Land Transport Authority (LTA) speed camera/red-light fines incurred during the rental period, damage assessments, late return charges, or fuel shortages.

   Deposit Release: Remaining deposit funds will be refunded following vehicle inspection and clearance upon return.

   Flight Delays, Extensions & Late Return Fees

   Grace Period: A complimentary waiting period of 60 minutes is provided for flight arrivals at Nadi International Airport or pickups at Lautoka Depot.

   Rental Extensions: Any request to extend the rental duration must be submitted at least 12 hours prior to the scheduled return time and is strictly subject to vehicle availability.

   Late Return Fee: Unapproved late vehicle returns will incur a late fee of $20.00 FJD per hour (or part thereof) beyond the scheduled return time, up to a maximum daily rate charge.

   Nominated Drivers Only

   Driver Authorization: ONLY the nominated primary driver (and explicitly listed additional drivers on the written rental agreement) is legally permitted to operate the vehicle.

   Unauthorized Drivers: Allowing any non-nominated driver to operate the vehicle strictly voids all insurance coverage, making the primary renter personally liable for 100% of all damages, third-party losses, or vehicle replacement costs.

   Insurance Claims & Excess (Deductible) Liability

   Standard Excess Claim: Standard commercial motor insurance carries a maximum excess claim liability of $4,000.00 FJD per incident across all fleet vehicles.

   Excess Reduction Option: If the optional Excess Reduction Insurance ($15.00 FJD/day) is selected during checkout/booking, the excess claim liability is reduced by half to $2,000.00 FJD per incident.

   Driver Requirements & Eligibility

   Age Limit: All drivers must be aged between 21 and 75 years.

   Driving Permit: Drivers must present a valid, full physical national driving license or an International Driving Permit (IDP) held for at least 2 consecutive years.

   Mileage Policy

   Unlimited Mileage: All self-drive rentals include Unlimited Kilometers across Viti Levu.

   Fuel Policy

   Same-to-Same: Vehicles must be returned with the exact same fuel level as provided at pick-up (e.g., half tank to half tank, full tank to full tank). Missing fuel below the initial dispatch level will be deducted from the security deposit at local service station rates.

   Territorial Boundaries & Off-Road Restrictions

   Permitted Roads: Vehicles are strictly restricted to paved, legally gazetted public roads on the island of Viti Levu, Fiji. Driving on unpaved gravel tracks, beaches, or unsealed access roads is strictly prohibited.

   Inter-Island Transit: Shipping or transporting vehicles on ferries to other islands (e.g., Vanua Levu, Ovalau, Taveuni) is strictly prohibited.

   Water Crossing & Underbody Exclusion: Driving through floodwaters, river crossings, or seawater is prohibited. Damage caused by floodwater ingress, hydro-lock, or saltwater exposure is 100% non-insurable and will be billed directly to the renter.

    LTA Statutory Declarations & Traffic Fines

    Statutory Liability: Under Fiji Land Transport Authority (LTA) and Police regulations, the registered driver at the time of hire is solely responsible for all traffic infringement notices, speed camera fines, parking tickets, and police spot fines.

    Processing Fee: 313 Rentals reserves the right to charge an administrative fee of $50.00 FJD if LTA or Police statutory declarations must be processed on behalf of the renter following vehicle return.

11. 11

    Accidents & Mandatory Police Report

    Incident Reporting: In the event of any collision, theft, or third-party damage—regardless of severity—the renter must:

    • Immediately notify Fiji Police and secure an official Police Report / Station Diary Reference Number.
    • Contact 313 Rentals support within 2 hours of the incident.
12. 12

    Breakdown, Towing & Negligence

    Mechanical Faults: In the event of mechanical breakdown due to normal wear and tear, 313 Rentals will provide roadside assistance or a replacement vehicle.

    User Error / Negligence: If assistance or towing is required due to user error (e.g., running out of fuel, dead battery from leaving lights on, keys locked inside, or vehicles stuck in mud/sand), all towing and service charges will be charged to the renter.

13. 13

    Prohibited Uses

    The rental agreement will be immediately terminated, the security deposit forfeited, and full legal recovery initiated if the vehicle is used for:

    • Driving under the influence of alcohol, drugs, or illegal substances.
    • Sub-leasing, re-hiring, or carrying passengers for commercial fare (unauthorized taxi use).
    • Transporting hazardous materials or illegal contraband under Fiji law.
    • Racing, speed testing, or towing any other vehicle or trailer.
14. 14

    Governing Law & Jurisdiction

    Fiji Courts: This agreement is governed by and construed in accordance with the laws of the Republic of Fiji. Any legal disputes arising from this contract shall be submitted to the exclusive jurisdiction of the Courts of Fiji (Lautoka / Nadi Registry).
